1. Subject These conditions govern reservations made through this website for the Tourist Use Housing registered in the Tourism Register of Andalusia with the number VUT/MA/85203.

2. Booking confirmation and payment: The booking entails an obligation to pay and will only be confirmed once the payment has been authorised and the guest has received the corresponding confirmation email. If the payment cannot be completed or is declined, the booking will not be considered confirmed. Payments will be processed through the payment gateway enabled on the website. Apartamento NerjaChaparil does not store full bank card details.

3. Price: The total price of the stay, including applicable discounts, taxes and any other charges, will be displayed before the booking is confirmed. The price includes only the items indicated during the booking process. Any additional services must be expressly accepted by both parties.

4. Mandatory registration of travellers: In accordance with Spanish regulations, all guests must provide before arrival the identification data required for passenger registration. No copies or photographs of identity documents shall be kept. Failure to complete the mandatory data may prevent check-in and access to accommodation.

5. Check-in hours: from 4:00 pm to 11:59 pm. Check-out: before 11:00 am.

6. Cancellations: Unless a different cancellation policy is expressly displayed during the booking process, the following conditions shall apply, calculated with reference to 4:00 p.m. on the scheduled arrival date:

a) Cancellation more than 5 calendar days before arrival: 100% refund of the amount paid.

b) Cancellation from 5 calendar days until more than 72 hours before arrival: 50% refund of the amount paid.

c) Cancellation 72 hours or less before arrival: the amount paid is non-refundable.

d) In the event of a no-show or voluntary early departure, no refund will be made for unused nights.

e) Refunds will normally be made using the same payment method used for the reservation.

7. Right of withdrawal: Reservations for accommodation services provided on a specific date or during a specific period are not subject to the general 14-day right of withdrawal. The cancellation conditions set out in section 6 shall apply.

8. Use of the accommodation and damages: The guest undertakes to comply with the house rules, use the facilities properly and avoid causing inconvenience to neighbours. The guest will be responsible for damage, loss of keys or missing items attributable to the guest or any member of their group. Any charge must be supported by reasonable evidence of the damage and its cost. Normal wear and tear is excluded.

9. Liability: The holder will not be liable for loss, theft or items forgotten during the stay, except in cases legally provided.

10. Force majeure: If the accommodation cannot be provided due to extraordinary and unavoidable circumstances beyond the owner’s control, the guest will be informed as soon as possible. Any amounts corresponding to services not provided will be refunded, without prejudice to any other rights recognised by applicable law.

11. Data protection: Personal data will be processed in accordance with Regulation (EU) 2016/679 (GDPR) and Organic Law 3/2018, as stated in the Privacy Policy available on this website, which provides information about the data controller, the purposes and legal basis of processing, recipients, storage periods and rights of data subjects.

12. Applicable law: These conditions shall be governed by Spanish law. For any dispute, the courts and tribunals that are competent in accordance with consumer and user regulations will be competent.

13. Incidents, complaints and claims: Any incident related to the accommodation should be reported as soon as possible so that an appropriate solution can be offered during the stay. This communication does not limit the guest’s legally recognised rights. Official Complaint and Claim Forms of the Regional Government of Andalusia are available to guests at the accommodation.
